All our kitchen cabinets are covered by the manufacturer warranty, only the original purchaser of material or products supplied by tommydsonline shall be entitled to this warranty which shall provide that products supplied by tommydsonline will be free from defect in workmanship under normal use and service for the limited period of one (1) year from the date of purchase. The original purchaser shall be required to provide proof of purchase.
Written notice of any defect must be provided to tommydsonline and must include the date of purchase, proof of purchase and a detailed description of the alleged defect. tommydsonline may, at its option, provide repair parts or replace the material or product with a substitute product of reasonably equivalent value. In addition, tommydsonline may require a return of the material or product in the event of replacement. Any repair or replacement parts shall be at the expense of tommydsonline but the original purchaser shall bear any and all other expenses, including, but not limited to, removal costs, transportation, reinstallation, communication and any additional service which may be requested by the original purchaser. Any repaired or replaced item or product shall only receive the unexpired portion of the applicable original warranty. tommydsonline will use reasonable efforts to obtain for the original customer the benefits of any manufacturer’s warranty with respect to the material or product sold. Any limitation or exclusion of state law in the state where the original customer resides may modify the terms and conditions of this limited warranty. Other rights may be available to the original consumer depending upon the law of the state where the original consumer resides.
EXCEPT AS SPECIFICALLY PROVIDED HEREIN AND EXCEPT TO THE EXTENT REQUIRED BY APPLICABLE LAW, TOMMYDSONLINE MAKES NO WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, WITH RESPECT TO THE MATERIAL OR PRODUCTS SUPPLIED, THEIR CONDITION, DURABILITY OR SUITABILITY. ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR USE FOR ANY PURPOSE SHALL BE LIMITED TO THE SHORTER OF THE PERIOD PROVIDED BY LAW OR THE PERIOD OF THIS WARRANTY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOMMYDSONLINE SHALL NOT BE LIABILE OR INCUR ANY LIABILITY WHATSOEVER FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES SUSTAINED IN CONNECTION WITH ANY DEFECT IN OR CONDITION OF ANY MATERIAL OR PRODUCT SUPPLIED. THE EXPRESS WARRANTY ABOVE CONSTITUTES THE SOLE AND ENTIRE WARRANTY AND IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED.
The limited warranty provided by tommydsonline shall not apply to any damage or loss suffered as a result of normal wear, accident, misuse or the failure to provide reasonable and necessary maintenance and service. The limited warranty shall not cover the improper installation or unauthorized repair, alteration, or modification of defects in the material or product when same is installed.
